What is a criminal trial in
Massachusetts, and how does it work?
A Massachusetts criminal trial takes
place in district or superior court, and is conducted in front of 6 or
12 jurors in the case of a jury trial, or a judge in the case of a bench
trial. The District Attorney presents any alleged evidence to the
jury. It can be physical evidence, or witness testimony. In a criminal
trial, the arresting police officer is often the key witness.
The defense lawyer also can present
evidence, and challenge the prosecutor's evidence and witnesses during
cross examination.
At the conclusion of the trial, you will
be found either not guilty, or be found guilty and face sentencing.
